We have been receiving requests from apprentices, who have completed initial training in marine Engineering from various approved marine workshop to grant them exemptions from subjects of MEO Class IV part A. These candidates have been inducted into such training before 1st August 1998, i.e. before the M. S. STCW Rules, 1998 came in force.

Clause 4.11 of Section M-III/1 of META Vol. I indicate that such candidates are also eligible to appear in Class IV Part A Examination conducted under 1998 rules if they are eligible under 1989 rules.

Rule 13 of Section M-III/9 deals with details of exemption granted from requirement of rule. It may be appreciated that these exemptions are meant for those, who have commenced their initial training after 1st August 1998 and not before, for whom the exemptions as they existed under M. S. (Examination of Engineers Rules), 1989 and subsequent instructions prevail. This is in line with the general conditions of legal interpretation of Rules that have been repealed, for the sake of natural justice, and therefore must be given its due consideration.
