Guidelines for registration as Bunker Suppliers as per MARPOL Annex VI 73/78



In continuation of the
  Engine Circular No. 45 regarding
Guidelines for registration as Bunker Suppliers as per MARPOL Annex VI 73/78 all bunker suppliers are required to register with the Directorate, by 19th May, 2005, in order to comply with the MARPOL 73/78Annex VI. In accordance to Regulation 18 of Annex VI, fuel oil for combustion purposes delivered to and used on board ships shall be recorded by means of a Bunker Delivery Note (BDN). This implies that a BDN shall be presented for every delivery by Bunker terminals, Barge or trucks and for every grade.

Needless to mention that any bunker supplier not registered with the Directorate shall in no case supply bunkers to the Foreign going vessels, however for vessels trading exclusively on Indian Coast are exempted till 31st August'2005 for completion of registration process by all bunker suppliers.
In case the foreign going vessel is found to have received bunkers from unregistered bunker supplier, the flag State or port State control authorities may detain the vessel.
                                                                                                                   

For implementing the above-mentioned regulations the Directorate General of Shipping (DGS), has made mandatory the adoption and implementation of a Quality Management System (QMS) in line with ISO 9001:2000 by the Bunker Suppliers, by April 2005. However, most of the bunker suppliers were unable to implement the same due to shortage of time. As such, an interim Registration Certificate valid for a period of 6 months is being issued to the companies not having ISO certification for " bunker supply chain" management so as to enable them to implement the quality system within this period
. It may also be noted that companies who have been issued with a certificate for a period of 6 months will not be granted any extension nor their certificates renewed till such time they have a quality management system for the bunker supply chain.

In view of the above, following guidelines are issued and are required to be followed strictly: -

1.      All Bunker Suppliers shall implement the Quality Management System (QMS) in line with ISO 9001:2000, within the period of interim certificate, and a copy of the certificate shall be submitted to the Directorate.

2.      For renewal of the Bunker registration Certificate, the Company may be required to undergo inspection by the surveyor of this Department, so as to verify –

         i. Compliance with the regulations of MARPOL 73/78 Annex VI as applicable.

         ii. Issuance of Bunker Delivery Note (BDN) and bunker sample as required by the regulation.

         iii.Quality Management System.

3.      The bunker supplier shall, from time to time, intimate the Directorate of any change in the place of business and apply for a fresh certificate on payment of a fee.

4.      Fuel oil quality would be subjected to flag State and port State inspection, they may verify the content of bunker delivery note with the port where the note was issued, and also may take fuel oil sample to verify conformance with MARPOL 73/78, Annex VI requirements..

5.
      On receipt of a report or a complaint from the port State authorities/ flag State authorities, the Directorate may initiate appropriate action against suppliers who have been found to have delivered non-compliant fuel to ships, and may lead to suspension or withdrawal of the Certificate as deemed fit and communicate the same to the Bunker Supplier.
     
    This issues with the approval of the Chief Surveyor with the Government of India.
